The national and local elections are deem scheduled 9th of May 2022 but we are already seeing politicians merely starting their political campaigns though they aren't yet filed their candidacy. The question is, how the Philippines constitutional law sees such act: legal or a violation?
The Commission on Election (COMELEC) asserted that there is no such thing as "premature campaigning". In a news released by Philippine News Agency, Commissioner Antonio Kho, Jr. said that politicians who appear on television, among others, cannot be considered as doing a political campaign.
“It’s like this, there is no such thing as premature campaigning, legally speaking. The Supreme Court has ruled on that, premature campaign. Let us say, today, we’ve seen a politician, local officials or national official on TV, etc., we cannot consider that to be a political campaign because he is not yet a candidate. So there is nothing wrong with that,” the poll body official said.
Moreover, in an online article titled "Premature Campaigning—Everything You Need to Know" it states that: (1) Premature campaigning is not illegal (2) A candidate cannot be disqualified for premature campaigning (3) Politicians are only liable for election offenses only at the start of the campaign period. Politicians who filed their candidacies are only deemed as candidates at the start of the campaign period (4) There is a significant time between the filing of candidacy and the start of the campaign period—this was intended for the printing of ballots and preparations of the COMELEC for the elections. In this span of time the Supreme Court said that the politicians who filed their candidacies are not yet liable for election offenses.
Based on the Calendar of Activities for the May 2022 National and Local Elections (NLE), earlier released by the COMELEC, the filing of the COCs for national and local candidates will be from October 1 to 8.
Above facts only informing us that nothing to condemn nor to criticize those unofficial candidates whom tarps and posters are already hanging on public spaces. Meaning, just ignore "Run, Sara, Run" campaign banners because Sarah Duterte herself is not yet filing certificate of candidacy.
